Quentin Brogdon’s article, “Texas Supreme Court Lets Drunk Drivers Take The Fifth After Drinking a Fifth” is a review of the recent Supreme Court opinion in In re Taylor Brock Peters. In the opinion, the Supreme Court dealt with a situation wherein the needs of litigants in a civil case conflict with the assertion of the Fifth Amendment of the U.S. Constitution. In the underlying case, an injured motorist sought information from the drunk driver about the identity of the bars that served him alcohol prior to the collision. Ultimately, the Court found that the Fifth Amendment trumps discovery needs in civil cases, even if the assertion of the privilege means that the civil action is barred from proceeding.
