Brogdon’s article “How Accurately do Jurors Assess Risk?” was published in Texas Lawyer Magazine on March 25, 2025. In the article, he explains that jurors are asked to assess risk in every tort case, but posits the question if it is a reasonable assumption that jurors assess risk with reasonable accuracy. Brogdon provides examples of assessing risk with respect to different situations under the personal injury umbrella, as well as explores the notion that humans use mental shortcuts and both logic and emotion when making decisions everyday.
